Privacy Policy

Redback Energy Holdings Pty Ltd ACN 677 012 869 and its affiliated group companies (“Redback”, “we”, “us”, “our”) are committed to protecting your “Personal Information” in compliance with our obligations under the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (“APPs”).

       1. Scope of this Privacy Policy

This Privacy Policy (“Policy”) explains how Redback collects, uses and discloses Personal Information when we interact with you and where you visit and use Redback websites, the Redback User Portal, the Redback App, other application websites, and mobile platforms (each, a “Service”) as well as the Redback social media platforms, marketing events, or where you otherwise interact with us.

All who visit, use, register, or log on to use the Services, shall be “Users” for the purposes of this Policy. Users are referred to in this Policy as “you” or any other applicable form of second-person pronoun. Redback may supplement this Policy with additional privacy terms or with additional privacy notices in connection with certain features of a Service. We will notify you when a Service you use has additional or altered privacy terms.

       2. Collection of Personal Information

Redback collects Personal Information from you in two ways: directly from your input; and automatically through the Service’s technologies which can collect information about our customers and the public.

While you do not have to provide us with your Personal Information, if you do not do so then we may not be able to provide you with our products or Services, communicate with you, or respond to your enquiries.

       2.1. Information provided by you

The types of information Redback collects directly from you may include the following, as well as any other information type that we expressly ask you to provide:

  • identification information e.g., name, date of birth;
  • contact details e.g. email, phone number, residential address;
  • financial information e.g., bank account information and the details of your debit card or credit card;
  • employment information e.g., employer name, occupation, industry;
  • internet activity e.g., search and browsing history; and
  • interests and communication preferences.

       2.2. Information collected automatically

Redback may automatically collect certain information regarding your use of the Services. Examples of information that may be collected automatically include:

  • Internet Protocol (“IP”) address used to connect your computer to the internet;
  • computer, device and connection information, such as browser type and version, operating system, mobile platform and unique device identifier (“UDID”) and other technical identifiers;
  • Uniform Resource Locator (“URL”) click stream data, including date and time, and content you viewed on a Service;
  • location information for location-aware Services to provide you with more relevant content for where you are in the world;
  • operation and system performance data of Redback products, and other products which operate with Redback product, connected to a Service (this includes running state of individual components, battery temperature, communication status, uptime);
  • energy and other electrical data, including usage and production, voltage levels, state of charge of the battery and appliance use;
  • Service use, including Redback User Portal and Redback App use.

If we combine any automatically collected information with Personal Information, the combined information will be treated by us as Personal Information. Although we may also use aggregated information for any reasonable and necessary purpose, this information does not identify specific individuals.

       2.3. Cookies

We and our third-party service providers may use technologies like cookies and web beacons on our website and Services. A cookie is a small text file that a website places on your device to store information, Cookies and other technology like web beacons may be used for purposes including:

  • facilitating login processes;
  • administering, customising and improving the Services;
  • personalising your browsing experience,
  • advertising, promotions, surveys, and reporting; and
  • tracking and analysing user preferences and trends.

You can refuse to use cookies by selecting the appropriate settings in your browser. However, if you do this, you may not be able to use the full functionality of the website.

       2.4. Third parties

You may be able to access third-party websites or services through our website or Services. In all cases, your use of these third-party websites or services will be governed by their own policies. You should make sure you have read and understood those policies.

       3. Use of Your Personal Information

We use and disclose your Personal Information for the reasons we tell you about, and as otherwise permitted by applicable laws. For example, we use the Personal Information collected through the Services to complete various actions including:

  • to provide, improve and develop the Services;
  • to provide customer support;
  • to respond to requests, inquiries, complaints or applications;
  • to update you on relevant new services and benefits;
  • to personalise the Services and to select content to be communicated to you or to use features on the Services;
  • to contact you regarding our products or services or products and services of third parties;
  • to conduct website administration, such as technical support of our websites and computer systems;
  • for a purpose that is compatible with the original purpose as is described to you at the time of collection;
  • for data analysis, audits, developing new products, enhancing the Services, identifying usage trends, determining the effectiveness of our promotional campaigns;
  • to prevent and detect security threats, fraud or other malicious activity;
  • compliance with legal and regulatory requirements (including providing assistance to law enforcement, judicial, regulatory or other government agencies and statutory bodies);
  • to resolve disputes and enforce agreements;
  • if you are seeking employment or other appointment with us, to:

           i. process and assess your application;

           ii. perform background checks;

           iii. verify your credentials and qualifications as well as obtaining employment references; and

           iv. carry out other activities related to the recruitment process; and

  • in other ways to which you have expressly agreed with us.

We may also collect, hold, use and disclose your Personal Information for other purposes which are within reasonable expectations or where permitted by law.

We may on occasion also match and combine the Personal Information that you provide with information that we obtain from other sources or that is already in our records, whether collected online or offline or by predecessor or affiliated group companies, for the purposes described above.

       4. Sharing or Disclosing Your Personal Information

In addition to the ways that we may use your information that are outlined in section 3 of this Policy, we may also share your Personal Information in the following ways:

       4.1. General sharing and disclosing activities

  • Affiliates: Your Personal Information may be accessible to all affiliated companies of Redback worldwide for the purposes described in this Policy.
  • Retail partners: If you request more information on the Redback range of products, or if you request a quote, your Personal Information may be made available to one or more Redback partners.
  • Service providers: Your Personal Information may be made accessible to our external service providers and suppliers who assist us with producing and delivering our products and Services to you, operating our business and marketing, promotion and communications. These providers and suppliers include, for example, reviewers, customer support, installers and shipping agents.
  • Sponsors, business or joint venture partners: Your Personal Information may made be accessible to our agents, representatives, sponsors and other entities for which we are acting as a joint venture or business partner.
  • Other third parties: We may share Personal Information with other third parties. We will tell you about these potential disclosures before we make them.
  • Compliance with applicable law and similar obligations: We may share Personal Information in order to:
       (i) respond to or comply with any law, regulation, subpoena or court order;
       (ii) investigate and help prevent security threats, fraud or other malicious activity;
       (iii) enforce and protect the rights and properties of Redback or its affiliates; or
       (iv) protect the rights or personal safety of our employees and third parties on or using our property.
  • Change in corporate circumstances: In the event of an actual or prospective business asset or share purchase transaction (such as any merger, acquisition or asset sale), any business partner, prospective investor, assignee, or transferee for the purposes of facilitating such a transaction.

       4.2. Additional sharing activities – third party network operators

We work with third parties who either provide a service to you, or who improve the delivery and function of our Services. With your prior consent, we may share information about your energy and other electrical data, including information about usage, solar production, and voltage levels with these third parties.

If you are a current Redback customer, you can manage which third parties we share your Personal Information with and access information about what is shared by logging into your inverter’s dashboard and clicking on the subscription tab.

       5. Cross-Border Disclosure

By using our website or a Service you consent to the transfer of information to countries outside of your country of residence which may have different Personal Information protection rules than in your country.

Your Personal Information may be transferred to other countries including the United States, China, Hong Kong, and Singapore for reasons as described in this Policy or where we are compelled to do so by the relevant authorities of the jurisdictions in which we operate our business (as applicable in the circumstances).

If we transfer your Personal Information outside of Australia in this way, we will take reasonable steps to ensure that your privacy is protected in a manner which is consistent with Australian privacy laws or in certain circumstances, we may rely on allowable exceptions under applicable laws in relation to the transfer. You agree to the disclosure of your Personal Information to overseas entities when you accept and agree to this Privacy Policy and access our products and Services.

       6. Children’s Privacy

Our Services are not designed for children under the age of 16. If we discover that a child under the age of 16 has provided us with Personal Information, we will delete that information.

       7. Your Choices and Selecting Your Privacy Preferences

You can manage available communications preferences by updating your Redback account preferences, or where applicable, by using “opt-out” or unsubscribe mechanisms or other means that we will provide within the communications that you receive.

You may request that we do not disclose your Personal Information to other organisations for the purpose of direct marketing. You can also request us to disclose where we obtained your Personal Information from, if we did not directly collect the information from you (for example, through a purchased list).

       8. Access to and Accuracy of Your Personal Information

You may request access to Personal Information about you that you have provided to us through the Services. You may also request to review and correct any of that Personal Information.

You should ensure that all Personal Information submitted to us is complete, accurate, true and correct. Further, when you provide us with any Personal Information relating to a third party (including your spouse, children, parents and/or employees), you represent and warrant to us that you have obtained the consent of the third party to provide us with their Personal Information. To view and change Personal Information that you provided to us, you can return to the Web page where you originally submitted your data and follow the instructions on that Web page. Please note that, for all requests to access your Personal Information:

(a) you must put your request in writing for security reasons;

(b) in order for us to provide any Personal Information we must verify your identity and may request further information about your request;

(c) we may refuse access to your Personal Information if it would affect the privacy rights of other persons, or if permitted in some jurisdictions, if it breaches any confidentiality that attaches to that information;

(d) we may refuse your request where we are legally permitted to do so and will give you reasons for the refusal and inform you of any exceptions relied upon under applicable law (unless it would be unreasonable to do so);

(e) we may take a reasonable time to process your application for access as we may need to retrieve information from storage and review the information in order to determine what information may be provided;

(f) we may charge a reasonable administrative fee for retrieving your Personal Information;

(g) if we are satisfied that your Personal Information is inaccurate, out-of-date, incomplete, irrelevant or misleading, or if you request us to correct your Personal Information, we will take reasonable steps to notify that third party of any correction;

(h) if we refuse your request to correct your Personal Information, we will provide you with written notice explaining the reasons for the refusal to the extent that it is reasonable to do so and provide the mechanisms available to complain about the refusal.

       9. Security

We take appropriate security measures to protect your Personal Information from misuse, interference or loss, and from unauthorised access, modification or disclosure. The information we hold about you may be stored electronically in Australia and overseas. We use your information only in accordance with this Policy and take all steps reasonably necessary to ensure we keep your information secure.

The security measures that we may take to protect your Personal Information include:

(a) physical measures: physical records of your Personal Information will be stored in a properly locked place;

(b) electronic measures: computer data which contain your Personal Information will be stored in computer systems and storage mediums subject to strict login restrictions;

(c) management measures: only staff members duly authorised by us can access your Personal Information, and these staff members shall comply with our internal code concerning Personal Information confidentiality;

(d) technical measures: encryption techniques, such as Secure Socket Layer Encryption, may be used to convey your Personal Information; and

(e) other measures: our network servers are protected by appropriate firewall(s).

Notwithstanding the above, please note that we will not be held liable or responsible for any loss, misuse or alteration of Personal Information that may be caused by third parties. The Personal Information collected and processed solely by the third party, independently from our processing activities are not subject to this Policy. Before submitting Personal Information to them, please read and understand their privacy policy/notice/statement.

       10. Retention of Personal Information

We will only retain Personal Information for only as long as there is a business or legal need to do so. In the event that retention of Personal Information is no longer necessary for any business or legal purposes or when the purpose for which the Personal Information was collected is no longer being served by the retention of the Personal Information, we will remove, destroy or anonymise/de-identify the Personal Information. The period of retention may extend beyond the termination of our relationship with you.

       12. Changes to Privacy Policy

We may modify this Privacy Policy at any time. If we do so, we will post a revised version of this Privacy Policy on our website. Your continued use of the Services will be taken as your acceptance of the amendments.
